Nibrary Terms of Service

Welcome to Nibrary and thanks for using our services.


Please read the following terms of services (“Terms”) before you access Nibrary or use Nibrary services. By accessing Nibrary or using Nibrary services, you agree to this Terms, which are subject to change without notice to you from time to time.  By accessing Nibrary or using Nibrary services, you agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. Your use of a particular Nibrary service may be subject to the regulation of special terms for such service. The materials contained in this web site are protected by applicable copyright and trade mark law. 


Nibrary provid services “AS-IS” and assumes no responsibility for any mistake and failure in delivering our services. Nibrary can terminate Nibrary Services to you, or add limits to our Services at any time, and Nibrary will not be responsible for any loss caused by changes of services or termination of services, unless otherwise agreed in an agreement between Nibrary and you. Advertisements may be included in Nibrary services. You may be contacted by us via e-mail regarding our services.


As Nibrary’s users, it is your obligation to maintain your registration information constantly to keep it true, accurate and current. If Nibrary suspects that registered information is untrue, inaccurate, not current or incomplete. 

It is your responsibilty to maintain the confidentiality of your account password and you are fully responsible for all activities that occur under your password or account. You agree to immediately notify Nibrary of any breach of security, including, but not limit to, unauthorizing use of your password. Nibrary cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

Nibrary is concerned about the safety and privacy of all its users, particularly children. Children under age 14 are not allowed to register and visit Nibrary without parent’s or guardian’s consents. Please send the Parent’s or guardian’s consent to:


Nibrary does not control all information, such as data, text, software, music, sound, photographs, graphics, video, messages, or other materials (“Content”), uploaded, , transmit or posted via the Nibrary Services and, as such, does not guarantee the accuracy, integrity or quality of such Content. 

You understand that by using the Nibrary Services, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Nibrary be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted or otherwise made available via the Nibrary Services.

You agree that Nibrary may display advertisements and promotions on the service and that Nibrary shall not be responsible or liable for any loss or damage of any sort incurred by you as a result of the presence of such advertisers on Nibrary services or your subsequent dealings with advertisers.


You agree that by accessing, or using Nibrary services, you do not

(1) violate any local laws and regulations of Nibrary and of your location,

(2) infringe other’s intellectual property or property right,

(3) reveal other’s privacy and identity,

(4) contain harmful, abusive, hateful and obscene language,

(5) seduce minors or harm minors,

(6) transmit or upload advertisements of any kind, promotional materials, “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation,

(7) transmit or upload advertisements of any kind, promotional materials, unless otherwise agreed between you and Nibrary.

(8) transmit or upload virus or do anything that may damage the operation of Nibrary,

(9) disrupt the order of all Nibrary services, or stalk another user 

Nibrary retains the right to remove or block any content under its sole discretion.


You or a third party licensor, as appropriate, retain all patent, trademark and copyright to any Content you submit, post or display on or through Nibrary services and you are responsible for protecting those rights, as appropriate. By submitting, posting or displaying Content on or through Nibrary services which are intended to be available to the public, you grant Nibrary a worldwide, non-exclusive, royalty-free license to reproduce, adapt, modify, publish and distribute such Content on Nibrary services for the purpose of displaying, distributing and promoting Nibrary services. Nibrary reserves the right to syndicate Content submitted, posted or displayed by you on or through Nibrary services and use that Content in connection with any service offered by Nibrary. Nibrary furthermore reserves the right to refuse to accept, post, display or transmit any Content in its sole discretion.

You represent and warrant that you have all the rights, power and authority necessary to grant the rights granted herein to any Content submitted.  

You agree to indemnify and hold Nibrary, and its subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of Content you submit, post, transmit or make available through the Service, your use of the Service, your connection to the Service, your violation of the TOS, or your violation of any rights of another.

You acknowledge that Nibrary may establish general practices and limits concerning use of the Service, including without limitation the maximum number of days that email messages, message board postings or other uploaded Content will be retained by the Service, the maximum disk space that will be allotted on Nibrary’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that Nibrary has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that Nibrary reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Nibrary reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice. 

The Service may provide, or third parties may provide, links to other World Wide Web sites or resources. Because Nibrary has no control over such sites and resources, you acknowledge and agree that Nibrary is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that Nibrary shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource. 

10. COPYRIGHTS and COPYRIGHT AGENTS respects the intellectual property of others. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify To make a copyright infringement notification, please consult your legal counsel or refer to 17 U.S.C. Section 512(c)(3) for the requirements.

     You must follow the following procedures to make a copyright infringement notification to us.

1. Identify the infringed material on, by providing the specific and direct URL to the specific web page containing infringing material; if the material is embedded within a page, you must specifically identify the elements that are allegedly infringed;

2. Provide written documentation to support your claim of copyright ownership or that you are an authorized agent of the copyright owner; If the copyright is registered, please provide the copyright certificate; if the work has not been registered, or you are acting on behalf of the copyright owner, a statement that the copyright claim is accurate and made under penalty of perjury must be provided;

3. A statement that you hold a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner or the law.

4. Your contact information, such as address, phone number, fax number and email address.

The Terms constitute the entire agreement between you and Nibrary and govern your use of the Service, superceding any prior agreements between you and Nibrary.Any claim relating to Nibrary’s service shall be governed by the laws of the State of Pennsylvania without regard to its conflict of law provisions.
